Mother of knife-wielding man killed by SPD officer suing officer, city

The mother of a man fatally shot by a Shreveport police officer last year after wielding a knife is suing the city and the officer who fired the shot.

According to her attorney Nelson Cameron, Marjorie Shepherd filed the lawsuit on behalf of her son 58-year-old John Shepherd Tuesday. The lawsuit states that on October 15, 2013, SPD officer Phillip Tucker violated John Shepherd's constitutional right to be free from excessive force when Tucker shot him in the chest with a shotgun at point blank range.

"Officer Tucker was responding to a call that a man at Shepherd's home was having a seizure and had a knife. Instead of arming himself with less than lethal force such as a taser or mace, Tucker took a shotgun loaded with buck shot from the trunk of his patrol vehicle," Cameron wrote in a news release.

"When Officer Tucker closed the car trunk and put the shotgun in his hands, he also closed any hope for John Shepherd. Tucker impatiently forced the situation to a crisis, instead of taking thoughtful, measured action," Cameron added. "Within 120 seconds of Officer Tucker arriving on the scene, John Shepherd, a peaceful man by nature, lay in his blood in his driveway."

The lawsuit states Marjorie Shepherd suffered mental distress, invasion of privacy, pain and suffering, lost of earning capacity and a list of other things. She is seeking compensatory, consequential and punitive damages.

John Shepherd was shot once by Officer Tucker, while responding to a request for assistance with Shepherd, who was reported at the time as exhibiting "an altered level of consciousness" in the 500 block of Americana Street just before 8 p.m.

When officers arrived on the scene, Shepherd reportedly approached officers and fire department personnel with the knife. SPD spokesman Cpl. Marcus Hines said Tucker "issued him multiple loud, verbal, commands to put the knife down. It is alleged the Shepherd, upon refusal of commands to disarm, began to rapidly advance toward officer Tucker who in response, fired a single shot striking Shepherd in the upper body."

Shepherd was taken to University Hospital Shreveport where he was pronounced dead.

No charges were filed against Tucker in this shooting. According to a statement released in December detailing the Caddo Parish District Attorney's office findings, "Shepherd presented an immediate deadly force threat to Officer Tucker as well as Shreveport Fire Department personnel on the scene."
