ETX man shot by fire marshal released from hospital, booked into jail

SHREVEPORT, LA (KSLA) -

The East Texas man who was shot by a local fire marshal early Saturday morning has been released from the hospital and booked into jail on a charge of aggravated assault. 

Police say 39-year-old Kenny Wayne Davlin pointed a rifle at firefighters who were battling a house fire in the  1500 block of Peach Street in Kilgore, Texas around 1 a.m. Saturday. Davlin was reportedly near the scene, arguing with his wife, and appeared to be intoxicated.

Davlin got upset when a fire marshal tried to confront him and moments later he returned with a rifle and pointed it at officers, they said. That's when the fire marshal, identified by police as Brandon Bigos, shot him. "I am very proud of my fire marshal," said Chief John Bellows of the Kilgore Fire Department."An event that took place could have meant that we were responding to a scene with fatality firefighters and civilians. "Due to his quick actions and calmness, he controlled the situation and possibly saved many lives. For that I believe we have a hero in our midst." 

Bigos has been placed on paid administrative leave, which is standard procedure. The nvestigation is ongoing by the Texas Rangers and the Kilgore Police Department. 

Investigators believe the fire and shooting are connected. Davlin was taken into custody upon his release from the hospital and charged with aggravated assault on a public servant. Records show that Davlin was previously arrested for assault and drunk driving.
