Couple says fired live-in nanny won't leave

UPLAND, CA (KCAL/KCBS/CNN) – A California couple says their nanny is refusing to move out – weeks after being fired – and police told them there is nothing they can do for now.

Marcella and Ralph Bracamonte served their live-in nanny with legal papers to quit and leave their home.

They say the 64-year-old woman is refusing to work or watch their three children. She just stays in her room and eats.

The couple hired Diane Stretton in March after placing an ad on Craigslist. They say she is now threatening to sue them for breach of contract, wrongful termination and false imprisonment.

The Bracamontes say police told them they can’t do anything without formal eviction papers.

"Because when I called the police they were telling me it's now a civil matter and that I have to evict her,” Marcella Bracamonte said. “So, this lady is welcome inside my house anytime she wants, to eat my food anytime she wants and harass me, basically. I'm now a victim in my own home and it's completely legal."

Stretton has three days to respond to the legal notice she received on Wednesday.

KCAL reports Stretton has been involved in several past lawsuits, including cases involving family members.
