Miller one of six SWAR counties not issuing same-sex marriage licenses

MILLER COUNTY, AR (KSLA) -

An Arkansas Circuit Judge has made a ruling striking down the state's ban on same-sex marriages, and while many are linking up to take advantage of the decision, some counties are saying 'not so fast.'

Jimmy and Emily Megason were married Monday morning at the Miller County Courthouse by Justice of the Peace Andy LaGrone. He said he was proud to perform this traditional wedding but said his civil duty stops when it comes to same-sex marriages.

"I have a book right here that says that is wrong and I absolutely refuse to do such," LaGrone said. "I might get sued if I do."

In the State of Arkansas, county clerks' offices issue marriage licenses.

"We are not issuing same-sex marriage at this time," said Ann Nicholas, Miller County Clerk.

Today Nicholas said her staff has been busy answering questions about same-sex marriage. There were only six counties affected by the decision to strike down the state's ban on same-sex marriage and Miller County was not one of them.

"We are waiting on an appeal which has been filed by the attorney general's office to the supreme court and when the court makes its ruling then my understanding based on information from counsel then all 75 counties will be involved," she said.

Regardless of the supreme court's ruling, LaGrone said he is not going to change.

"I am from the old school and very traditionalist," he said. "That's the way I was brought up and that is the way I am going to stay."

The Arkansas counties affected by the ruling are Pulaski, White, Lone Oak, Saline, Washington and Conway.
