A retired East Texas pharmacist is in jail after repeatedly sexually assaulting a teenage girl.

According to an arrest warrant affidavit, 73-year-old James Carey Prosperie sexually assaulted a girl under the age of 17 multiple times during summer break. Prosperie was arrested on Tuesday following a stand-off with police at his Tyler residence.

In a forensic interview, the victim told police Prosperie made her participate in sexual acts, beginning a couple of weeks after school let out for summer.

According to the arrest warrant affidavit, Prosperie's wife saw her husband "whispering and smiling" at the girl. His wife told investigators "she had a bad feeling about what she saw."

Court documents reveal that the girl told Prosperie's wife that he was sexually assaulting her. Prosperie's wife informed the victim's parents who then filed a police report.

The arrest warrant affidavit states that James Prosperie refused to speak with Tyler Police investigators. However, a CPS report states that Prosperie "confessed to a lawyer/friend that he has had 'sexual contact' with [the girl] on at least two separate occasions."

Propserie remains in the Smith County Jail on a $100,000 bond. If he posts bond, Prosperie is ordered to submit to weekly testing for controlled substances in his body. Prosperie is also ordered to remain at least 500 feet away from the victim or anywhere she may be located at any time. He is not allowed to communicate with the victim or use, possess or consume any alcoholic beverage, illegal drug or narcotic.
