NACOGDOCHES, TX (KTRE) -

Nacogdoches Police have charged a Nacogdoches woman accused of excessively spanking a five-year-old girl after she claimed to catch her trying to smoke a marijuana cigarette in April.

A detective obtained an arrest warrant for Diana Evette Matthews, 25, on a charge of third-degree injury to a child on Wednesday and police arrested her the same day.

According to the affidavit, an officer was dispatched to Nacogdoches Memorial Hospital on Tuesday. The officer spoke to a woman who said she had discovered multiple healing injuries from the buttocks area to the ankles of her niece, a five-year-old child.

The woman said she was caring for her and her twin brother and the twin told her that their mother, Matthews, had spanked the girl with a belt.

Police then interviewed Matthews and she said that on April 15, she found the child trying to smoke a marijuana cigarette and spanked her, according to the affidavit.

Matthews denied any drug use, but said the marijuana may have come from someone else in the home.

Matthews bail is set at $7,500.
