Judge allows AG Cuccinelli to withdraw from Executive Chef case

RICHMOND, VA (WWBT) -

A Richmond judge allowed Virginia Attorney General Ken Cuccinelli to remove himself and his office from an embezzlement case involving the former Executive Chef.

Cuccinelli had filed a motion to withdraw from the case due to conflicts involving the charges against Todd Schneider. Greg Underwood, who works with the Commonwealth's Attorneys office out of Norfolk will take over the prosecution.

Judge Margaret P. Spencer scheduled another hearing on May 14th to hear a motion by Schneider's defense team to have the case thrown out.

Todd Schneider served as Executive Chef under Gov. Bob McDonnell from 2010 to 2012. He was indicted on four counts of embezzlement, but claims he's a whistle blower and the charges against him are retaliation.

The FBI is now looking into the political scandal at the Executive Mansion.

Lawyers accuse Governor Bob McDonnell's sons of taking Gatorade and protein powder from the mansion to their college dorms. They also say one of the governor's daughters took booze for a private party. There are even accusations that the governor's wife gave away pots and pans.

Schneider says the charges are retaliation for providing information to law enforcement officials on the governor and his wife's relationship with Star Scientific, a Glen Allen nutritional supplement firm.

The owner of Star Scientific, Jonnie Williams, is a major donor to the governor and paid $15,000 for the catering at the wedding for McDonnell's daughter, which Schneider catered.

The governor has consistently declined to comment about specifics because of the criminal case against the chef, but he did say this week Star Scientific and its owner received no special treatment from him.
