Stonewall man gets life for rape of stepdaughter, 12

DESOTO PARISH, LA (KSLA) -

James L. Horton, 34, was sentenced Wednesday to life in prison without benefit of probation, parole or suspension of sentence for the aggravated rape of his 12-year-old stepdaughter.

The rape resulted in the girl becoming pregnant. After she gave birth, the DeSoto Parish DA's office collected Horton's DNA and matched it to the victim's baby.

According to the DA's office, the victim impact hearing became emotional as one of the victim's grandmothers stated that the defendant had stolen the childhood of the victim. The grandmother was accompanied to the stand by the victim and by BACA, Bikers Against Child Abuse, whose members consoled the victim and the grandmother as she told the jury her plight.

The other grandmother also took the stand and told the jury of the effects of the defendant's act upon the family. She ordered the defendant to look at her as she tore up a picture of the family that contained Horton's image. She told him that he tore up their family the same way that she tore up the picture. She told Horton that the family was serving a life sentence and that he should have to serve a life sentence also.

The defendant refused to look at her keeping his eyes downcast or occasionally looking at the judge or his attorney.

As the judge sentenced the defendant to life in prison, spectators in the courtroom erupted in spontaneous applause.

Under Louisiana law, aggravated rape carries a mandatory sentence of life in prison without benefit of probation, parole or suspension of sentence.
