Homer Police Chief Russell Mills has filed another lawsuit against the town, this time to stop the Mayor and Board of Selectmen from removing their term limits.
Mills won a legal battle last week to keep his job and to keep the town's police department from being disbanded.
A Claiborne Parish district judge voided the town board of selectmen's February 11 vote removing the chief and dismantling the police department.
The ruling came after the board voted in a special meeting to authorize the town attorney to admit in court that they had violated the open meeting law by conducting the vote in executive session.
Mills' latest lawsuit asks the court to stop the town from enforcing a motion was also made during the February 11 meeting that was apparently intended to remove term limits for the Mayor and the Board of Selectmen.
The suit alleges that the town violated public meeting laws and Louisiana state laws regarding amendments of Charter by failing to give proper notice of the specific item regarding term limits that had been placed on the agenda.
Mills' suit also asserts that the board's vote to revert to a prior ordinance that they erroneously believed would remove the term limits was never made law of the town, because it was rejected by voters and therefore never cleared by the State Attorney General's Office or approved by the Governor.
